    Do I have a choice as to who I use as my conveyancer?

    Sometimes real estate agents will insert their choice of conveyancer into the Offer and Acceptance, to act on your behalf. This is usually someone they have had dealings with before. If you don't want to use whoever the real estate agent selects you don't have to. Just let them know that you wish to

    Do you do family law for Legal Aid clients in children's matters?

    Unfortunately we cannot provide family law assistance to Legal Aid clients. If due to your circumstances you cannot fund your own representation in a children's matter, you should speak to Legal Aid directly.

    How do I appoint Ellery Brookman as my conveyancer?

    Write Ellery Brookman at the base of your Offer and Acceptance as your choice of conveyancer. The real estate agent will then send the Offer and Acceptance to us and we will get in touch with you once we receive it.

    I want to buy or sell land or a business privately but I don't have a contract. Can you help me with that?

    Yes, we can. It's not uncommon for clients to require the drafting of an offer and acceptance if they are buying land from or selling land to a family member or friend. If you contact us to make an appointment we can help you prepare the paperwork you require as well as going on to effect the settle

    Yes, we would be more than happy to provide you with advice about whether your offer and acceptance addresses all of your needs and requirements before you sign it.     Can you help me transfer my house from my name solely to the names of my partner and I jointly?

    Yes, we can, and will advise you on ways of doing this which will be exempt from transfer (stamp) duty.

    Do I have to pay up front?

    In most cases, yes, you will need to make an upfront payment or set up a regular deposit of funds into our trust account in order for us to provide you with family law representation. Sometimes arrangements can be made for payment on the sale of property or when funds are received from the other par

    We are separating and want to sort our property out by agreement. Can we both come in to see you at the same time?

    We must act for one party or the other. We cannot act for both and you should not bring your ex-partner with you to your initial appointment. You are most welcome to bring any other family or friends to your appointment for support.

    Is it okay if I bring my children to a family law appointment?

    You should make arrangements for your children to be cared for as they are unable to attend family law appointments.

    Where the property is a unit/apartment, and an Owners Corporation (Body Corporate) is involved, an extra charge will apply for each Owners Corporation Certificate purchased.
