CAPAX LEGAL FAQ

What is exchange of contracts?

A contract to sell a property becomes binding when the buyer and the seller each sign a copy of the contract and exchange them through their solicitors/conveyancers. At exchange, the buyer pays the vendor a deposit (10% of the price unless a different amount is agreed by the parties).

What happens at settlement?

At settlement, through their respective solicitors/conveyancers, the purchaser pays the vendor the balance of the purchase price (having adjusted outstanding rates between the parties) and receive the transfer signed by the vendor. The agents of the parties' banks will also attend settlement.

Do I need to be present at settlement?

You don’t need to attend settlement in person. The parties' solicitors/conveyancers or their settlement agents will attend settlement to exchange cheques with transfer documents.

Price includes:

  • * The above price does not include disbursements (around $200 - see the bottom of this page) that will be charged additionally. Any cost for building, pest or strata inspection (if required by client) also needs to be paid by the client. In the case of an off the plan unit purchase, our fees are $1,650 (Incl. GST) + disbursements.
  • Our service includes the following:
  • Providing legal advice on the contract & sending requisions on title to the vendor's solicitor;
  • Preparing transfer & electronic Notice of Sale;
  • Conducting searches for outstanding council rates and water rates;
  • Providing the vendor's solicitor with settlement adjustment sheet that adjust rates & levies between the parties;
  • Making arrangements for the settlement with the vendor's solicitor and the purchaser's bank and notifying the client of any shortfall between the loan amount and funds required for settlement;
  • Attending to the stamping of contract; and
  • Attending settlement and reporting of the settlement to the client.

  • Our service includes the following:
  • Preparation of the contract for sale;
  • Responding to the requisitions on title by the purchaser;
  • Arranging for the execution of transfer by the vendor
  • Checking settlement adjustment sheet prepared by the purchaser's solicitor;
  • Booking of settlement with the purchaser's solicitor and the vendor's bank;
  • Obtaining mortgage payout figure from Lender;
  • Sending cheque directions to the purchaser's solicitor;
  • Attending settlement on completion date; and
  • Reporting of settlement to the client.

Where the property is a unit/apartment, and an Owners Corporation (Body Corporate) is involved, an extra charge will apply for each Owners Corporation Certificate purchased.
