    How should I pick my lawyer?

    Don't just pick your lawyers on their advertising. Make sure they are experienced and an expert in the field of your case. Look for expertise and depth of knowledge.

    How does the payment structure work?

    If we accept your case, you don't pay us anything until your claim succeeds. Fees depend on the quantity of work we need to do for your case. We give you a clear and concise estimate before we start.

    How do I know if my claim is worth pursuing?

    Generally a claim will always be worthwhile unless they consist of trivial injuries, or there is no insurer or party at fault.

    Who can claim?

    If you are injured as a result of the fault of negligence of another person, you are generally entitled to compensation for any resulting injury.

    Can I claim at any time after my injury?

    No, strict time limits operate in personal injuries actions. For most claims you must supply to the insurer of that at-fault party, a Notice of Accident within 1 month, whereas claims against an employer has a limitation of 3 years. Don't Delay!

    What is included in a claim?

    General damages for things such as pain and suffering, past wage and income losses of earning capacity, domestic assistance and future domestic assistance and expenses.

    Do I have to go to court?

    Most cases can be settled out of court after medical and income loss investigations are completed and the various losses are totalled. On the basis of this formulation, your claim can then be taken to the defendant's insurer and may be settled out of the court room.

    What if I am not the person who was injured?

    If you were a bystander or another person closely connected to persons killed or maimed, you may have a psychiatric injury caused by witnessing the accident or its aftermath and can claim for nervous shock. There is however, no compensation allowable for 'mere' grief or sorrow.

    What are the damages for workplace injury?

    Damages are available for expense recovery, lost income, loss of future earning capacity, pain & suffering, loss of life enjoyment and paid & unpaid assistance. These rights are in addition to standard WorkCover payments.

    Where the property is a unit/apartment, and an Owners Corporation (Body Corporate) is involved, an extra charge will apply for each Owners Corporation Certificate purchased.
