FAQ
Tindall Gask Bentley Lawyers FAQ

How do you sort out issues about children?

The best way to sort these issues out is to talk to you ex-partner and reach an agreement. It is wise though to get independent legal advice before you do that so you know exactly where you stand.

Are there time limits?

You can make an application to the Family Law Courts for orders to be made about children's matters at any time. If your circumstances change, or your ex-partner's circumstances change, you can reapply to the court for existing orders to be changed or new orders to be made.

What happens to your child or children in the meantime?

The court will often make 'interim' orders about your child while you and your ex-partner wait for the trial. Those interim orders can be very important, because once you get to trial one of the things that the court will consider is the 'status quo' - the current situation. If your child is happy a

What happens if you reach an agreement?

If you reach agreement with your ex-partner it is advisable to get the Family Law Courts to make an order that reflects what you have agreed. This commonly happens when there are several family members with competing interests such as a new spouse and a child from a previous relationship. Some Wi

The best way to avoid a dispute is to have a legally drafted Will that clearly states your intentions, and to review your Will regularly to ensure that it is up to date. If we prepare a Will for you then we can advise you on how to minimise the possibility of your Will being challenged or your estat

What happens when Wills are challenged?

Whatever the origin of the dispute our first step is to get a copy of the Will and to make an assessment about the likelihood of the claim being successful. We try to resolve these disputes quickly and cost effectively, by negotiation. If that isn't possible we have the skills and experience to take

When must a claim be made?

A claim must be made within 6 months of Probate being granted. We recommend that you get legal advice as soon as possible after the dispute arises.

What are you entitled to claim for?

Before your claim is finalised we will take into account your pain and suffering, the wages that you have lost (from not being able to go to work), the medical expenses that you have incurred and may incur in the future and your loss of future earning capacity (if your ability to work is reduced). W

What will we do if you have a claim?

If you have a claim then we will handle all negotiations with the responsible party (or their insurance company). We will get medical reports from doctors relating to your injuries and, often, reports about the accident scene. Throughout your claim we will liase with you, the responsible party and t
